1. Acceptance
If you do not agree to these Terms, do not use the Service. If you use the Service on behalf of someone else, you confirm you are authorised to accept these Terms for them.
2. Eligibility
You must be at least 13 years old to use the Service. If you are below the age of legal majority where you live, you may only create an account with the involvement of a parent or guardian, and you may only pay for or earn money from content with their permission.
3. Your account
- Provide accurate information and keep it up to date.
- Keep your password confidential. You are responsible for activity under your account.
- We may ask you to verify your email address before you can use some features.
- We may suspend or close accounts that break these Terms, that are used to commit fraud or abuse, or that create legal or security risk for us or other people.
4. Your content
You keep ownership of the writing, images and other material you publish (“your content”). To run the Service, you grant ArtiStanza a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and deliver your content to the readers you make it available to, including through the Service’s pages, previews and downloads. This licence ends when you delete the content, except for copies retained in backups for a limited period and for records we must keep by law.
You confirm that you own your content or have all the rights needed to publish it, and that it does not infringe anyone else’s rights or break any law.
5. What you may not publish or do
- Content you do not have the right to publish, including plagiarism and unlicensed translations.
- Content that is illegal, defamatory, harassing, hateful, sexually exploitative of minors, or that incites harm.
- Malware, spam, scraping, or automated access that interferes with the Service.
- Attempts to bypass paywalls, copy protections, or access levels, or to redistribute paid content.
- Impersonation, or misrepresenting your identity, your work, or its ownership.
6. Reading and access
Creators decide what is free and what is paid. Paid content is made available to you under a personal, non-transferable licence to read it for your own use. You may not resell, redistribute or publish paid content anywhere else. Previews and free works are also licensed to you for personal use.
7. Payments
- Prices are set by creators and shown before you pay. Prices are charged in US dollars (USD) unless stated otherwise.
- Payments are processed by our payment provider, Stripe. We do not store your full card details.
- One-time payments unlock the specific work you bought. Memberships are recurring subscriptions that renew automatically at the interval shown, until you cancel.
- Cancelling a membership stops future renewals; you keep access until the end of the paid period.
- You are responsible for any taxes that apply to your purchases.
8. Refunds
Refunds are handled under our Refund Policy, which forms part of these Terms.
9. Creator earnings and payouts
When readers pay for a creator’s content, the creator receives the share of the amount paid that ArtiStanza and the creator have agreed individually in writing, and ArtiStanza retains the rest as its platform commission. The platform’s standard commission is 10%, but the rate for any given creator is the one set out in their own agreement, which may differ. Payouts are made to creators monthly, in USD, once the creator’s balance meets any minimum payout threshold applied by the payment provider, and once the creator has provided the details needed to pay them. Creators are responsible for their own taxes and for providing accurate payout and tax information.
10. Termination
You may stop using the Service at any time. We may suspend or end your access if you break these Terms or if we are required to by law. Where it is reasonable and lawful to do so, we will try to give you notice.
11. Disclaimers
The Service is provided “as is”. We do not guarantee that it will be uninterrupted, error-free, or that content will be accurate or suitable for any purpose. Content is created by users, not by ArtiStanza.
12. Limitation of liability
To the fullest extent allowed by law, ArtiStanza is not liable for indirect, incidental or consequential losses, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the three months before the claim, or USD 50.
13. Changes to these Terms
We may update these Terms from time to time. We will update the date at the top of this page and, for significant changes, give notice on the Service. Continued use after a change means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Nepal, and the courts of Nepal have exclusive jurisdiction over any dispute, without affecting any rights you have under mandatory consumer-protection law where you live.
